Alberto Cuervo , Coordinator and Professor at Bureau Veritas Training , specializing in New Technologies Law .

A question we often ask ourselves is whether the role of the Data Protection Officer (known as DPO) is mandatory for all companies and entities.

Based on a true story. Two friends, Sandra , head of an employment office, and Beatriz , headmistress of a private school, met up as they did every week to go to the swimming pool. After the swimming session they went for a drink. And after discussing various issues, the DPO came up .

They had read a lot of information about it, but they had chinese america data many doubts. So they decided to call their friend Alberto , a lawyer and expert in New Technologies Law , who lived very close by, so that he could have a coffee with them and explain certain issues to them.

– Alberto, what is a DPO?

Look, as you know, it is essential to properly regulate the processing of personal data, and currently there is the General Data Protection Regulation , a new regulation that affects us and that includes the activity of the DPO .

As of May 25, 2018, this position will be mandatory for certain companies . This is an expert in data protection , who advises and works together with the Data Controller or Data Processor .

And you may ask, what are these two positions for?

1- The Data Controller is the natural or legal person who decides on the purpose and use of data processing and what should be done with personal data, even if he or she does not do so himself or herself.

2- The Data Processor is the natural or legal person who processes such data in accordance with the instructions of the Data Controller due to a legal relationship or a contract existing between both parties.

The clearest examples of Data Processors are:

Hosting service providers .
Agencies that prepare payrolls.
IT service providers or providers of services for the destruction of confidential documents, data and files.

– Alberto, is it mandatory for our companies or entities to have a DPO?

Yes, in your case it is necessary, because the existence of a DPO will be mandatory , starting next May 25, in the following cases:

– For all public authorities, except Judges and Courts.

It would be any entity , authority or official that performs public functions , such as Public Administrations , Professional Associations , civil servants and in the case of notaries and property registrars . Therefore, in your case Sandra ; you work in an employment office, which is a public entity; you should have it.
