The General Personal Data Protection Law – Law No. 13,709/2018 – is the Brazilian legislation that regulates personal data processing activities. Access the law on the Planalto website.
Initially scheduled to come into effect in August of this year, the legislation has already passed through the Chamber of Deputies and the Senate and the most recent information is that the LGPD – also known as the Data Confidentiality Law – will come into effect after being sanctioned or vetoed by the President of the Republic.

The LGPD aims to create a scenario of legal security, with the standardization of rules and practices, in order to promote the protection of personal data for every citizen in Brazil.

Approved in 2018, the LGPD was scheduled to come into force on August 14 of this year.
However, a provisional measure by the President suggested postponing the law's validity until May 2021, as he understood that society would not be able to adapt to the LGPD until August due to the novel coronavirus pandemic. After passing through the Chamber of Deputies and the Senate, this provisional measure was not accepted and the law was sent to the Presidency. What is certain is that the LGPD will come into force sooner or later. Until then, it is necessary to prepare.
