The Frankfurt Higher Regional Court has ruled that it is not permissible to use a well-known brand as a keyword and then to portray this brand in a negative light - for example by portraying the competitor's offers as being of inferior quality or too expensive. In principle - and this is the crucial point - it is permissible to use the competitor's brand as a keyword.
This is an important finding in any case. From self employed database our point of view, it is advisable in many cases, from an economic point of view, to include the brand names of competitors in your own AdWords keyword list. Especially if there is a chance that the searcher will switch to my offer or is also interested in alternative offers.
